PITFIT Rules & Regulations


  • All sessions, packages, and memberships are non-refundable.

  • All classes and/or memberships must be utilized within the stated expiration dates as agreed at the time of purchase. Failure to utilize purchased classes and/or memberships before the expiration date shall result in loss of class/membership credits not used.

  • Reserved sessions must be changed/canceled within 12 hours of scheduled start time or will be forfeited. For individual classes and package classes, failure to show up for a scheduled session without cancelling (“no-show”) shall result in a loss of session. For monthly membership classes, failure to show up for a scheduled session without cancelling (“no-show”) shall result in a $20.00 penalty.

  • Monthly Memberships

    • Monthly memberships require an initial minimum commitment of three (3) months and shall automatically renew thereafter unless terminated in accordance with the provisions herein. 

    • Monthly memberships shall be paid in advance on a monthly basis on the calendar date upon which the membership became activated for the following month. Payment for monthly memberships shall be made via automatic debited payment (credit card, debit card, or automatic checking account draft). You hereby authorize PITIT (or its agent) to automatically debit the card on file for the monthly membership until it is cancelled according to the terms and conditions herein.

    • In the event of a declined credit card/debit card, your account will be immediately suspended, pending the submission of updated, successful payment information. You will still be responsible for the monthly membership charges until such membership is cancelled in accordance with the terms herein. 

    • After the expiration of the initial three (3) month term, 30 days’ advance written notice is required to cancel a monthly membership.

    • In the event an injury, illness, or move out of the region occurs, the monthly membership may be cancelled on less than 30 days’ advance notice provided that proper documentation (e.g., substantiating illness, injury, or move) is submitted. This provision can also be invoked to cancel the monthly membership before the expiration of the three (3) month minimum time period provided the same substantiating documentation is provided.

  • If recovering from injury or illness, notify instructor prior to session start time.

  • You must arrive and check-in 15 minutes prior to the start of the session, or your spot may be released to a wait-listed client.

  • We ask that you respect our trainers and our clients. For that reason, any client who arrives to a session 5 minutes after the scheduled start time may only be allowed into class at the instructor’s sole discretion. In the event the instructor does not permit a late entry, the session will be forfeited. 

  • Clients are expected to be properly dressed and prepared for class. Specifically, clients must wear appropriate athletic attire, which includes athletic tops, bottoms, and shoes suitable for the activity. Clients are also expected to maintain a level of personal hygiene that does not distract other class members in the PIT (e.g., no strong perfumes, wear deodorant). 

  • Clients shall not be permitted to enter the PIT until the trainer has indicated it is safe and they are ready for client entry. To ensure the safety of our trainers and other clients, you are required to follow this and all other trainer instructions. 

  • Cell phones are not permitted in the PIT during a session. This will be strictly enforced as necessary to protect the safety of all clients and trainers.

  • Clients must clean their equipment after use using the cleaning supplies located around the PIT. 

  • Clients shall only use the equipment in the PIT in the manner in which it has been designed and in the manner in which the trainer has instructed. Failure to do so may result in injury and/or damage to equipment. In the event of damage to equipment due to client misuse shall result in client forfeiting all classes/memberships and being banned from the PIT.

  • PITFIT reserves the right to ask any client being disruptive to leave class. In the event a disruptive client is told to leave class, client shall forfeit all classes/memberships. Being disruptive during class includes, but is not limited to, using equipment when not instructed to do so and/or performing exercises other than those the trainer has instructed during class.

  • PITFIT is not responsible for property that is lost, stolen, or damaged while in, on, or about the premises.


 

Assumption of the Risk and Waiver of Liability 


You hereby acknowledge that you have voluntarily chosen to participate in an intense physical exercise program. You further understand that PITFIT is located in an open-air environment. For these reasons, you understand that the conditions in the PIT may vary based upon the weather outside and that hot weather, cold weather, and humidity may be present and create conditions that require care to navigate (e.g., floors may become slippery in humidity). You agree to assume all risk in participating in an intense physical exercise program under extreme weather conditions and agree that PITFIT shall not be liable for any injury you sustain that is related to any weather conditions. You further understand and acknowledge that PITFIT is located in a parking garage and that trainers utilize parking garage structures, such as the parking garage ramps and stairwells. You agree to assume all risk associated with utilizing these parking garage structures and agree that PITFIT shall not be liable for any injury you may sustain from utilizing the stairs or parking garage ramps, including, but not limited to, those that may be sustained as a result of drivers or others in the parking garage. You understand that PITFIT strongly recommends that you consult with my physician prior to commencing any sessions and assume the risk of injury for failing to do so. 


By signing this document, You acknowledge that you have been fully informed of the strenuous nature of this exercise program and you agree to assume the risk for my health, safety, and well-being, and any injuries, damages (both economic and non-economic), or losses you may sustain during my participation in PITFIT. You understand and acknowledge that the use of exercise equipment involves risk of serious injury, including permanent disability and death. You hereby knowingly and voluntarily, on behalf of myself and my heirs, successors, and assigns, forever waive, release, discharge and hold harmless PITFIT and park cities personal training and any of their heirs, successors, partners, assigns, agents, and/or representatives from any and all liability, damages, losses, suits, demands, causes of action (including, without limitation, negligence) or other claims of any nature whatsoever, including, without limitations, any loses for property damage, personal injury or death, arising out of or relating in any way to my participation in or use of any facilities, equipment or machinery in connection with PITFIT. 



Specific Assumption of the Risk and Waiver of Liability Relating to Coronavirus/COVID-19


The novel Coronavirus, COVID-19, has been declared a worldwide pandemic by the World Health Organization. COVID-19 is extremely contagious and is believed to be spread mainly from person-to-person contact. As a result, federal, state and local governments and health agencies recommend social distancing and have, in many locations, prohibited or limited the congregation of groups of people.

PITFIT has put in place preventative measures intended to attempt to reduce the spread of COVID-19, including, but not limited to specific sanitation procedures and distancing of equipment, but PITFIT is not conducting temperature checks for participants and each participant is responsible for monitoring their own health prior to attending PITFIT and complying with any federal, state, or local government or health agency rules and/or recommendations related to minimizing their COVID-19 infection risks. PITFIT cannot and does not guarantee that you will not become infected with COVID-19 from participation in PITFIT and/or use of PITFIT equipment and/or facilities. Further, attending PITFIT could increase your risk of contracting COVID-19.

By singing this agreement, you acknowledge the contagious nature of COVID-19 and voluntarily assume the risk that you may be exposed to or infected by COVID-19 by attending PITFIT. Such exposure or infection may result in personal injury, illness, permanent disability and/or death. You understand that the risk of becoming exposed to or infected by COVID-19 at PITFIT may result from the actions, omissions, or negligence of myself and others, including, but not limited to, PITFIT employees, volunteers and class participants. You understand and acknowledge that PITFIT in no way warrants COVID-19 infection will not occur through participation in PITFIT and/or use of PITFIT equipment and/or facilities.


Release of Image


You understand that from time to time, trainers and others associated with PITFIT may take photographs, videos, or otherwise record the sessions in which you are a participant and that my image may be utilized in such recordings. You hereby grant and authorize PITFIT the right to take, edit, alter, copy, exhibit, publish, distribute and make use of any and all pictures or video taken of me to be used in and/or for any lawful promotional materials including, but not limited to, newsletters, flyers, posters, brochures, advertisements, fundraising letters, annual reports, press kits and submissions to journalists, websites, social networking sites and/or other print and digital communications, without payment or any other consideration. This authorization extends to all languages, media, formats and markets now known or later discovered.


This authorization shall continue indefinitely, unless you otherwise revoke this authorization in writing.


You further waive the right to inspect or approve any finished product in which my likeness appears, including written or electronic copy. 


You agree that you have agreed to this release without being compensated. You waive any right to royalties or other compensation arising or related to the use of the photograph. 


You understand and agree that these materials shall become the property of PITFIT and will not be returned.


You hereby hold harmless and release PITFIT from all liability, petitions, and causes of action which I, my heirs, representatives, executors, administrators, or any other persons may make while acting on my behalf or on behalf of my estate related to the use of my likeness as set forth herein.
